“Fatal Shooting in Opitsaht: RCMP Arrival to Incident in Less Than 5 Minutes”

Less than five minutes elapsed from the arrival of two RCMP officers in the remote island First Nations community of Opitsaht to the fatal shooting of a Tla-o-qui-aht First Nation man, as stated by one of the officers. Cpl. Daniel Macintosh provided this testimony during a coroner’s inquest regarding the death of Julian Jones, which occurred on February 27, 2021, after officers responded to reports of a woman being assaulted and confined in a home on the island.

This inquest aims to investigate the circumstances surrounding Jones’s death, with the jury tasked to formulate recommendations aimed at preventing similar incidents. Notably, the inquest does not seek to assign blame or criminal liability.

Const. David Robichaud, the officer who fired the shots that fatally wounded Jones, was summoned to testify but did not appear. Following the summons, Robichaud retired from the RCMP and relocated out of the province, citing legal obligations that exempt individuals residing outside British Columbia from testifying.

The Independent Investigations Office did not recommend charges against the officers after conducting an investigation.

Jones, who had prior convictions for various offenses, including assaulting a Tofino RCMP officer, was under restrictions not to contact several RCMP officers, including Robichaud, as confirmed by Jones’s parole officer David Paruk.

The sequence of events at the Opitsaht residence transpired swiftly, with Macintosh indicating that the entire incident occurred in under a minute after they knocked on the door. Inside, they heard a woman’s cries for help, men’s voices, and sounds of heavy furniture being moved.

Subsequently, Robichaud arrested John Lucas Jr., Jones’s brother, leading Jones to emerge and confront the officers, expressing concern for his brother’s well-being and issuing threats. Macintosh recalled seeing Jones brandishing what he believed to be knives and making an advance towards the officers despite verbal warnings to desist.

In a tense moment, Robichaud discharged a Taser at Jones, causing him to fall to the ground. However, Jones rose again and continued to approach the officers, prompting a series of shots fired by Robichaud.

Macintosh recounted that during the altercation, he retrieved metal objects from Jones’s possession, identified as metal files, and attempted to aid Jones, but the severity of the injuries dissuaded him from administering first aid.

Following the incident, Robichaud swiftly departed from the community, as he was already planning to transfer out of the Tofino RCMP. The inquest proceedings are ongoing.
