The courageous daughter of a disabled woman who was fatally assaulted by her cruel partner has recounted her harrowing experience in court. Robert Karl Huber, a 69-year-old man, subjected his partner, Lindy ‘Kimmy’ Lucena, 64, to repeated physical abuse throughout their five-year relationship before ultimately causing her death on January 3, 2023, in Ballina, Australia.
Under the influence of alcohol and sedatives, Huber viciously attacked Ms. Lucena, resulting in severe injuries. Testifying in the NSW Supreme Court, Ms. Lucena’s daughter tearfully described the horrific aftermath of the assault, emphasizing her mother’s immense fear and vulnerability during the attack.
Expressing the profound impact of losing her mother to such senseless violence, the daughter highlighted the heinous nature of the crime. While Ms. Lucena did not die directly from the injuries, the court determined that the beating significantly contributed to her death, compounded by underlying health issues and substance presence.
Huber, known for his history of controlling behavior and domestic violence incidents, was found guilty of causing Ms. Lucena’s death. Despite his remorseful statements, the judge dismissed his version of events as misleading, citing evidence of multiple strikes during the assault.
Justice Stephen Rothman condemned Huber’s lack of accountability and sentenced him to twelve years and nine months in prison, with a possibility of parole in October 2032. Following the sentencing, an investigation will be launched to scrutinize the circumstances of Ms. Lucena’s death and the handling of the domestic violence situation by the authorities.
