“Insurance Payout Woes: Homeowner Faces Financial Strain”

Antonina Gladkova faced challenges after a fire destroyed her property in early 2024, leading to financial strain and frustration amounting to tens of thousands of dollars. Initially relieved by the insurance company covering the costs of rebuilding her half of the semi-detached house in Georgetown, Ont., she encountered difficulties with her mortgage provider delaying insurance payments, forcing her to secure a private mortgage to bridge the gap and keep construction going amidst delays.

Gladkova’s situation is not uncommon, as legal experts note an increasing trend of issues arising from insurance payouts not aligning with contractor invoices. She aims to raise awareness about the pitfalls in mortgage agreements to help others avoid similar struggles.

Following a fatal fire in February 2024 that engulfed her property, Gladkova’s insurance claim for rebuilding was approved at over $508,000, managed by Simplii Financial. However, the release of funds did not match the contractor’s invoicing requirements, leading to significant financial strain for Gladkova and her partner.

Despite complaints and adjustments made by Simplii in the payment process, Gladkova had to resort to a private mortgage with high interest rates to cover the shortfalls. The reconstruction, delayed by about six months, incurred additional costs and legal fees, exacerbating the financial burden on the couple.

Simplii stated that their mortgage terms dictate the handling of insurance proceeds, emphasizing the need for clear communication and understanding of payment schedules between all involved parties. Fy Virani, a home insurance claim lawyer, highlighted the importance of proactive communication to ensure smooth coordination between lenders, contractors, and insurers to avoid payment discrepancies.

Gladkova’s complaint to the Ombudsman for Banking Services and Investments (OBSI) sought redress for the incurred interest and associated fees. While OBSI’s investigation acknowledged the bank’s lack of clarity in explaining potential financing needs, the compensation offered fell short of resolving the couple’s grievances. Gladkova’s pursuit of changes in mortgage agreements underscores the need for reforms to prevent others from facing similar hardships.
